These Terms of Use (“Terms”) govern your access to and use of the websites operated by Crunched Analytics LLC (“Crunched”, “we”, “us”, or “our”), including https://crunched-analytics.com and https://surveysays-community.com (collectively, the “Websites”). By accessing or using the Websites, you agree to these Terms. If you do not agree, do not use the Websites.

1. Who we are

Crunched is a United States-owned and operated market research company. We provide custom market research services to clients, and we operate Survey Says Community, a proprietary research panel where members may choose to participate in surveys and earn rewards.

2. Eligibility

You must be at least 16 years old to create an account or participate in Survey Says Community. By using the Websites, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top indicates when the Terms were most recently revised. Your continued use of the Websites after changes become effective means you accept the updated Terms.

4. Privacy and cookie practices

Our collection and use of personal information is described in our Privacy Policy, and our use of cookies and similar technologies is described in our Cookie Policy. By using the Websites, you consent to our data practices as described in those policies.

5. Use of the Websites

You may use the Websites only for lawful purposes and in accordance with these Terms. You agree not to misuse the Websites, interfere with their operation, or attempt to access systems or data you are not authorized to access.

6. Accounts and security (Survey Says Community)

Certain features, including panel participation through Survey Says Community, may require you to create an account. You agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts to protect members, clients, and the integrity of research data.

7. Survey participation, eligibility, and rewards

Survey opportunities are provided based on eligibility criteria and research quotas. Not every member will qualify for every study, and survey availability is not guaranteed. Reward amounts, redemption options, and timing may vary and are subject to verification and quality controls. We may withhold or reverse rewards in cases of suspected fraud, duplicate accounts, policy violations, or invalid responses.

You may opt out of panel communications and/or delete your account at any time from your dashboard, by using the unsubscribe link in survey invites, or by contacting support@surveysays-community.com.

8. Professional verification and third-party services

For certain audiences, we may offer optional verification methods (for example, professional verification via LinkedIn) to improve data quality. If you choose to use such features, you may be redirected to a third party and their terms and privacy practices will apply. We are not responsible for third-party services.

9. Intellectual property

The Websites and all content on them (including text, graphics, logos, designs, and software) are owned by or licensed to Crunched and are protected by intellectual property laws. Except as expressly permitted, you may not copy, reproduce, distribute, create derivative works, publicly display, or otherwise use our content without our prior written consent.

10. Feedback and submissions

If you provide feedback, suggestions, or other submissions to us, you grant Crunched a perpetual, worldwide, royalty-free license to use, modify, and incorporate such submissions into our products and services without compensation to you.

11. Prohibited conduct

You agree not to:

• Use the Websites in any way that violates applicable law or regulation.
• Attempt to probe, scan, or test the vulnerability of our systems or networks.
• Use bots, scrapers, or automated means to access the Websites without our permission.
• Impersonate another person or misrepresent your affiliation with any person or organization.
• Submit false, misleading, or duplicate survey responses or create multiple accounts to obtain rewards.
• Upload or transmit malware or engage in any activity that could disable, overburden, or impair the Websites.

12. Third-party links

The Websites may include links to third-party websites or services. These links are provided for convenience only. Crunched does not control and is not responsible for third-party content, policies, or practices. Your use of third-party sites is at your own risk.

13. Disclaimers

The Websites and all content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Crunched disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Crunched does not warrant that the Websites will be uninterrupted, secure, or error-free.

14. Limitation of liability

To the maximum extent permitted by law, Crunched will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Websites or any services offered through them.

15. Indemnification

You agree to defend, indemnify, and hold harmless Crunched and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Websites.

16. Governing law and venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Websites will be brought exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction and venue in such courts.

17. Termination

We may suspend or terminate your access to the Websites (including your Survey Says Community account) at any time if we believe you have violated these Terms or if necessary to protect the Websites, our users, clients, or the integrity of research data. Sections that by their nature should survive termination will survive (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification).
